Welcome to EZZYOWN, a platform operated by Brandbuddiez Technologies Pvt Ltd ("BBTPL"), an Indian company registered under the Companies Act, 2013. Our principal office is situated at Kia Park, Prathamesh Complex, Andheri West, Mumbai 400053. EZZYOWN serves as an online marketplace for the buying, selling, and advertising of pre- owned, refurbished, open-box new appliances, and other products. The Platform includes various services such as classified ads, listings, sales, purchases, and related support through our website www.ezzyown.com and its corresponding mobile application (collectively referred to as the "Service" or "Platform").
By accessing or using the EZZYOWN Platform and Service, you agree to adhere to and be bound by these Terms of Use. The terms "you" and "your" pertain to any individual or entity accessing or utilizing the Platform or Service, whether manually or through automated methods. If you disagree with any provision of these Terms or any modifications thereto, your sole remedy is to discontinue use of the Platform. EZZYOWN reserves the unilateral right to amend these Terms at any time, and the most recent version will be available on our Platform.
EZZYOWN functions as an electronic platform designed to facilitate communication for advertising, enabling sales, and sharing information concerning various goods and services. We do not assume possession of, nor do we partake in the distribution of, the goods or services listed by users on our Platform. It is advisable for users to exercise the same degree of caution and judgment as they would in traditional offline transactions before concluding any sale, purchase, or exchange of information. Adherence to our Listing Policy, which is an integral component of these Terms, is required.
In listing products or services on EZZYOWN, you agree to the following conditions:
Access to EZZYOWN is permitted solely for individuals who are citizens of the Republic of India, are 18 years of age or older, and are legally capable of entering into binding contracts. If you are accessing the Platform on behalf of a legal entity, you affirm that you have full authority to act on its behalf and that you assume responsibility for the entity’s actions on the site.
EZZYOWN does not exercise control over the quality or authenticity of the products listed by individual users. Users are strongly encouraged to exercise their own discretion and due diligence in assessing all relevant aspects before making any purchase. EZZYOWN does not endorse, either implicitly or explicitly, any product or service provided by advertisers or service providers.
EZZYOWN may impose fees for certain features or services, including but not limited to Featured Ads and Paid Ads. By using these services, you enter into a contractual agreement with EZZYOWN, and the terms governing these services are outlined herein. Payments for Paid Services may be processed through third-party payment gateways or other methods. Refunds or cancellations of Paid Services are subject to specific conditions as detailed below.
You agree to defend, indemnify, and hold harmless EZZYOWN, including its officers, subsidiaries, affiliates, successors, assigns, directors, agents, service providers, suppliers, and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorneys' fees) arising out of or related to: (i) your use of or access to the Platform and/or Service; (ii) any breach by you of these Terms; (iii) any infringement of third-party rights, including intellectual property rights; (iv) any claim that your Content has caused harm to a third party; (v) any failure to obtain necessary consents or comply with applicable laws; (vi) any disregard for applicable laws related to your products and services; and (vii) any failure to understand terms and conditions of third parties associated with products or services offered through our Platform. This indemnity obligation will remain in effect even after the termination of these Terms and your use of the Platform.
Under no circumstances shall EZZYOWN, including its officers, directors, employees, or agents, be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, even if EZZYOWN has been advised of the possibility of such damages. This includes, without limitation, damages resulting from the use or misuse of the Platform or Service, inability to use the Platform or Service, or any interruption, suspension, modification, or termination of the Platform or Service. This limitation extends to damages incurred due to other services or products obtained through, or advertised in connection with, the Platform or Service. These limitations shall be enforced to the fullest extent permitted by law, and will apply even if we were informed or should have known of the potential for such damages. You agree and acknowledge that EZZYOWN is not responsible for user submissions or the actions of any user or third party that may be defamatory, offensive, or illegal. The Platform is provided as-is and may not be suitable for use in locations other than India.
These Terms and any related policies shall be governed by and construed in accordance with the laws of India. Disputes arising out of or relating to the use of the Platform shall first be resolved through mutual discussions. If unresolved within fifteen (15) days, disputes shall be settled through arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration being Mumbai, Maharashtra, India. Arbitration proceedings will be conducted in English, and the courts in Mumbai, Maharashtra, India shall have exclusive jurisdiction.
All intellectual property rights associated with the EZZYOWN Platform, including trademarks, logos, and other proprietary marks, are owned by Brandbuddiez Technologies Pvt Ltd. Unauthorized use of these intellectual property rights is prohibited. Trademarks not owned by BBTPL that appear on the Platform are the property of their respective owners.
These Terms, along with the privacy policy and any other rules or policies posted on the Platform, constitute the complete and exclusive agreement between you and BBTPL regarding your use of the Platform and supersede all prior agreements or communications.
By submitting comments, ideas, suggestions, or any other content to BBTPL, you grant BBTPL a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, adapt, publish, reproduce, distribute, and create derivative works from such content. You warrant that you own or control all rights to the content and that its use by BBTPL will not infringe on any third-party rights.
Any disputes arising out of this agreement will be settled through arbitration, with the seat of arbitration in Mumbai, Maharashtra, India, in accordance with the rules of the Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a sole arbitrator mutually appointed by both parties.
Prices and products advertised on this Platform are for sale through the EZZYOWN website only. Prices and availability of products may vary between the online site and retail stores. Due to the possibility of changes in prices and product descriptions, EZZYOWN does not warrant the accuracy or completeness of information on the Platform and is not responsible for any typographical errors or discrepancies.
You should report any violations of these Terms using the link provided on the EZZYOWN homepage. Failure to act on breaches does not waive EZZYOWN’s right to address subsequent breaches. If actual damages are unquantifiable, you agree to pay EZZYOWN’s actual damages with a minimum amount of Rs 25,000/- or as reasonably calculated. EZZYOWN retains the right to seek equitable remedies, including specific performance or injunctive relief.
EZZYOWN is committed to protecting your privacy. Our Privacy Policy, available at www.ezzyown.com/privacy, outlines the types of personal information we collect, how we use it, and how we safeguard it. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
As a user of EZZYOWN, you have the right to access your personal data and request its correction or deletion in accordance with applicable data protection laws. You are also responsible for ensuring that the information you provide is accurate and up-to-date. Any misuse of your personal data or failure to comply with these Terms and the Privacy Policy may result in suspension or termination of your account.
In addition to arbitration, EZZYOWN encourages users to seek resolution through mediation. If mediation is unsuccessful, disputes will be resolved through the arbitration process outlined above. Mediation proceedings will be conducted in Mumbai, Maharashtra, India
